The Forsyth County Sheriff’s Office arrested 21-year-old BENITO SEGURA PENALOZA (pictured).


On April 14, 2025, FCSO Animal Services received a complaint about possible animal abuse at a property on 4381 Ben Lane in Walkertown.


An initial investigation led to the discovery and rescue of fifty-four (54) roosters as well as the confiscation of paraphernalia related to cockfighting.


As the investigation progressed, deputies acquired additional information that led them to an additional location. As a result, on April 17, 2025, deputies executed a search warrant at a property on 4411 Rocklane Drive where eighty-five (85) more roosters were discovered and removed along with “numerous additional paraphernalia items related to cockfighting and illegal drugs”, said the sheriff’s office.


The sheriff’s office tells me that no deceased animals were found on the properties.


Forsyth County Sheriff’s Office (FCSO) Animal Services officers have charged SEGURA PENALOZA with one felony count of cockfighting and one felony count of possession of a schedule II controlled substance.


SEGURA PENALOZA was transported to the Forsyth County Detention Center and given a $10,000 secure bond.

54-years-old JAMES ROBERT NIX JR. (pictured) was arrested for killing a former friend’s rooster, and after spending time behind bars, he is speaking out about his arrest.


According to court records, the incident took place on May 13, 2022, when Mr. Jason Defelice, came back home to find his rooster named Big Roo, lifeless in a ditch.


NIX told Action News Jax: “I just checked my mail and turn around and go, and I hear, ‘Bang, bang, bang, bang, bang!’ And I turn around, and there’s a chicken out there in the street. I said, ‘Oh boy, here we go’.”


NIX also said: “Turn around, walk to my place bang bang bang bang bang now the chickens in my yard! Now it’s neck flares up.”


NIX claims Big Roo was attacking him and he defended himself by hitting Big Roo in his small head with a stick resulting in Big Roo’s death.


Mr. Defelice recounted what happened that day: “I didn’t see my rooster at first, so I knew something was up because he would always come chase me.”

He and NIX are neighbors and used to be friends before NIX killed Big Roo.

Mr. Defelice said that when he did not see Big Roo coming to greet him, he went to see NIX.

He said: “Then, I went in his yard and yelled at him, and he finally came out and said he killed him.”

Mr. Defelice believes NIX killed Big Roo on purpose and said: “I lose them to animals, but I was not expecting to lose them to my neighbor that was like my friend.”


According to Mr.Defelice, he first called the Jacksonville Sheriff’s Office to report the incident but he did not receive any assistance. It was only until a few days later that he learned he could reach out to Animal Control and he did!

Following an investigation by Animal Control, on June 23, 2022, Task Force Officers with the Jacksonville Sheriff’s Office responded to Peeples Lane in Jacksonville and arrested NIX on aggravated animal cruelty, a 3-degree Felony.


Court records show that NIX’s arraignment is scheduled for July 14, 2022.


When you experience issues with your neighbors involving furbabies, reach out to the authorities so THEY can step in and resolve the situation. Under NO circumstances it is ok to take it upon yourself to kill innocent animals!
