MOISES L. GERMANGUERRERO arraigned on felony animal cruelty charges for killing two cats

I have emailed the Erie County District Attorney’s Office and requested information about the voiceless victims.

I have just heard back from the DA’s Office and this is what I learned: The first cat involved in the case, the one who was brought deceased to a veterinary hospital by GERMANGUERRERO’s girlfriend on March 29, 2021, was an 8-month-old male “orange tabby with white” named Hunter.


The second cat, the one who had to be euthanized in October 2021, was a 7-month-old male “orange tabby” named Lue.


I also requested their pictures but I was told that the office “cannot release any photos of the animals as these images are evidence in this case, which is pending sentence.”




~ Update: March 8, 2023


On March 7, 2023, 23-years-old MOISES L. GERMANGUERRERO, of Cheektowaga, pleaded guilty before Erie County Court Judge Kenneth Case to one count of Aggravated Cruelty to Animals (Class “E” felony). “The defendant pleaded guilty to the highest charge in the indictment against him,” said Erie County District Attorney John J. Flynn in a press release.


In 2021, the SPCA Serving Erie County started investigating GERMANGUERRERO following the suspicious deaths of his two cats.


On March 29, 2021, GERMANGUERRERO’s girlfriend brought a deceased cat to a veterinary hospital. The furbaby was later taken to the SPCA Serving Erie County where a necropsy determined that he/she died from blunt force trauma to the head. From the investigation it emerged that GERMANGUERRERO hit the cat with a closed fist, causing his/her death.


On October 18, 2021, GERMANGUERRERO’s girlfriend brought a second cat to a different veterinary hospital to be treated for head trauma. The furbaby was taken to the SPCA Serving Erie County and sadly, due to the severity of the injury, he/she was euthanized.

A veterinarian determined the second cat also died from blunt force trauma to the head, which was confirmed by a necropsy. An investigation into this incident revealed that GERMANGUERRERO fatally injured the second cat by hitting him/her in the head with a closed fist.


GERMANGUERRERO faces a maximum of only two years in prison despite being responsible for the death of two innocent cats. The murderer remains released on his own recognizance as the charge is a non-qualifying offense for bail.

Sentencing is scheduled for Monday, June 5, 2023, at 2:00 p.m.

Following an investigation conducted by the SPCA Serving Erie County into the suspicious deaths of two cats, Erie County District Attorney John J. Flynn announced that 21-year-old MOISES L. GERMANGUERRERO (pictured below), on October 27, was arraigned before Cheektowaga Town Court Justice David M. Stevens on two counts of aggravated cruelty to animals (Class E felonies).


In a press release Erie County DA Flynn said: “It is alleged that on March 29, 2021, the defendant’s girlfriend brought a deceased cat to a veterinary hospital, which was then taken to the SPCA Serving Erie County. A necropsy determined that the cat died from blunt force trauma to the head. The defendant is accused of hitting the cat with a closed fist, which caused the death of the animal.”


The release goes on to say: “It is further alleged that on October 18, 2021, the defendant’s girlfriend brought another cat to a different veterinary hospital to be treated for head trauma. The cat was taken to the SPCA Serving Erie County where it was euthanized due to the severity of the injury. A veterinarian at the SPCA determined the second cat died from blunt force trauma to the head pending results of a necropsy. The defendant is also accused of fatally injuring the cat by hitting the animal with a closed fist.”


Erie County DA Flynn explained that the charges are “non-qualifying for bail”, so the murderer was released on his own recognizance and is scheduled to appear in court on the morning of Thursday, January 6, 2022.


If convicted of all charges, the murderer faces a maximum of only 4 years in prison.


The case is being prosecuted by Assistant District Attorney Megan E. Mahoney of the Animal Cruelty Unit.
