JOHN PATRICK BANNAN convicted by Marshall County Jury of beating and killing an elderly neighborhood dog

Marshall County District Attorney Jennifer Bray announced that on the afternoon of August 13, 2026, a Marshall County jury found 56-year-old JOHN PATRICK BANNAN (pictured) of Union Grove, guilty of aggravated cruelty to animals following a trial presided over by Circuit Judge Matt Elliott.

According to a press release issued by the DA’s Office, evidence presented at trial established that BANNAN called an elderly Australian Shepherd named Jack over to him, grabbed the dog by the fur, violently slammed him onto the pavement, and beat him. BANNAN then shot Jack and disposed of his body. The press release stated that the incident was captured on video.

The Marshall County Sheriff’s Office was alerted to the incident, and when investigators questioned BANNAN about it, he lied to them about the last time he had seen Jack.

District Attorney Bray tells me that Jack’s family said he was 10 or 11 years old. They are unsure of his exact age because he was a rescue.

While testifying at trial, BANNAN ultimately admitted to killing Jack but argued that his actions were justified because Jack was on his property.

According to the press release, testimony, including from BANNAN himself, established that Jack was a well-loved dog who had never previously escaped his yard and posed no threat to BANNAN, his livestock, or anyone else when BANNAN “chose to brutally kill him.”

District Attorney Bray said: “Mr. Bannan had any number of reasonable options available to him. He could have taken Jack home, called a neighbor, or simply let him go. What he could not do was torture and kill a harmless dog simply because that dog wandered onto his property. As ADA Culbert told the jury in closing, the law in Alabama is not ‘Bannan law,’ meaning you cannot simply torture or kill a dog because it comes onto your property.”

District Attorney Bray explained to me in an email that the incident occurred on October 31, 2021, at approximately 5:15 p.m.

The Marshall County Sheriff’s Office arrested BANNAN on June 10, 2022, and he was originally charged with misdemeanor cruelty to animals. However, after review, the case was presented to the Marshall County Grand Jury for consideration of a felony charge. BANNAN was then indicted on the felony charge on June 13, 2023. After the indictment was issued, the original misdemeanor case was dismissed, and BANNAN was arrested on the evening of October 12, 2023, on the felony animal cruelty charge. He bonded out of the Marshall County Jail a few hours later.

District Attorney Bray further told me that the sentencing hearing has been set for October 5, 2026, at 9:00 a.m.
