The Indian River County Sheriff’s Office arrested 42-years-old MITCHELL ALAN GENS (pictured).

 

According to the arrest affidavit obtained by Voice For Us, on December 15, 2023, a deputy responded to a property on 11111 138th Avenue in reference to a hog who had been shot.

 

Upon arrival, a couple of witnesses told the deputy that GENS had chased their brown breeding hog from his property to theirs. They also said that as one of them was approaching GENS, GENS said he was going to kill the hog.

After hearing that threat, the witness became afraid of further confrontation with GENS who was also carrying a rifle.

 

As the hog ran back to his/her pen, GENS shot the defenseless animal with an AR-15 multiple times in the hip and belly area causing the hog to suffer before his/her death.

According to the witnesses, GENS had also shot the hog in the foot the night before.

 

One of the two witnesses took a picture of GENS as he was leaving the scene carrying a rifle and then showed it to the deputy.

The deputy looked at the deceased hog and reported seeing three gunshot wounds. One in the hip, one in the side of the belly, and one in the side rib cage area.

 

When GENS was contacted and questioned via cell phone, he told the deputy that the hog was going through his garbage and he tried to shoot him/her while chasing him/her off  his property but missed. GENS added that he was “allowed to shoot nuisance animals”, stated the affidavit.

GENS then agreed to meet with the deputy at the sheriff’s office to further discuss the incident.

 

During the interview, GENS stated that the hog had been rummaging through his trash numerous times in the past and that the day of the incident he caught him/her on his property going through his trash, so he took the rifle and shot the hog while he/she was still on the property.

According to GENS' statement, after being shot, the hog ran back to his/her pen and as GENS was following the animal, one of the two witnesses approached him. At that point GENS said he was going to kill the hog and the witness told him to go ahead. GENS stated he shot the hog approximately eight more times.

 

The murderer was placed under arrest on Sunday, December 17, 2023, and booked into the Indian River County Jail for felony Aggravated Animal Cruelty, which includes inflicting pain, serious physical injury, or death to an animal.

The following day GENS was released after posting a $1,000 bond. Court records show that GENS, of Fellsmare, is scheduled to be arraigned on February 1, 2024, at 10:00 a.m. before Judge Robert Meadows.

 

According to the affidavit, “The witnesses did not want to pursue charges for the incident.

 

Authorities did not disclose the hog’s name so I took the liberty of naming the Voiceless Victim Cinnamon for the tribute image. Should his/her given name be made public, I will rectify it accordingly.

During a press conference, Lee County Sheriff Carmine Marceno announced the arrest of 55-years-old ANTHONY LEE BELLMAN (pictured).

 

On Thursday, December 14, 2023, at 4:23 p.m. the Lee County Sheriff’ Office received a call from employees of the Family Dollar on 630 Bell Boulevard South in Lehigh Acres. The employees reported finding a trash bag inside the dumpster behind the store with something moving inside. When the employees opened the bag, they found a 16-year-old Shih Tzu, named Xyla, who had a  belt around her small neck. The Good Samaritans immediately took the Voiceless Victim to the Blue Pear Animal Hospital.

 

A deputy as well as Lee County Domestic Animal Services met with the Good Samaritans at the hospital.

 

An investigation was immediately launched and detectives obtained surveillance footage of the incident. The footage showed a male, later identified as BELLMAN, “arriving at the dumpster in his vehicle, exiting, clearly removing a bundled up trash bag from within his trunk, and then tossing the bag into the dumpster from several feet away.”      

 

As the investigation progressed, detectives learned that Xyla was micro-chipped and that her original guardians, from Delaware, were dead. According to court documents obtained by Voice For Us, detectives ran an extensive search on the original guardians’ family members and associates and the search returned BELLMAN residing on Carillion Avenue South in Lehigh Acres, approximately a mile away from the scene of the incident.

 

Detectives made contact with BELLAMAN, who was wearing the same clothes as the male in the footage.

The woman residing at the same residence, his wife, Colleen Bellman, turned out to be the daughter of Xyla’s original guardians.

 

A detective interviewed Mrs. Bellman at the residence and made sure there were no other animals. Mrs. Bellman told investigators that when her mother died, she took custody of Xyla. She also said that her husband was going to take Xyla to the Humane Society to put her down.

 

BELLMAN was taken in for questioning and detectives found probable cause to charge him with one felony count of aggravated animal cruelty.

 

BELLMAN was arrested and transported to the Lee County Jail A.K.A. Marceno Motel.

At the press conference Sheriff Marceno said: “Instead of landing in a dumpster, where he belongs, he landed in jail.”

 

Records show BELLMAN posted bond and was released a few hours later.

According to court records, BELLMAN is scheduled to be arraigned at Lee County Circuit Court on January 16, 2024, at 8:30 a.m. before Judge Bruce E. Kyle.

 

As for Xyla, she is still with Lee County Domestic Animal Services “running around”, said Sheriff Marceno. Xyla is partially blind and will soon be ready to be adopted.

 

Court documents reported the post-evaluation opinion of Jennifer E. Meredith, DVM:

 

The amount of time spent in a trash bag tied in a garbage can as well as with the severe matting and also given her age and possibly underlying cardiovascular disease indicated from my exam and her chest radiographs- she went through harmful and unnecessary suffering and pain during this time. She was also at high risk of suffocation, and heat stroke, and given her possible cardiovascular disease and confirmed severe matting-this would put her at even greater risk of heat stroke and suffocation. Heat stroke and suffocation, strangulation can also lead to secondary organ failure if not treated in time. This in and of itself can also be a very painful experience and the secondary no cardiogenic pulmonary edema that can develop from strangulation is the equivalent of drowning from the inside out.”

On the early morning of Thursday, June 9, 2022, 34-years-old MILES MATTHEW BERRY (pictured), burglarized Paw Works, an animal rescue shelter in Camarillo. BERRY stole a 3-year-old German Shepherd puppy named Pretty Girl.

 

According to a press release by the Ventura County District Attorney’s Office, BERRY “was seen on surveillance video hitting Pretty Girl as she resisted being taken from her individual kennel.”

 

At the time of the incident, Paw Works reached out to the public for assistance in hopes of finding the individual who had stolen Pretty Girl and released the video of the episode. Footage showed BERRY trying to take a dog who fought him off, and then moving to Pretty Girl’s kennel. In the devasting video, Pretty Girl can be seen fighting BERRY but he hits her twice with his flashlight.

 

Hours later, a passerby found Pretty Girl running between cars on U.S. Highway 101, gravely injured. The Good Samaritan took Pretty Girl to the Paw Works Veterinary Hospital. Sadly, due to the gravity of the injuries that Pretty Girl sustained, the sweet angel was euthanized.

 

A few months later, on or about September 4, 2022, Paw Works was again burglarized. On that occasion no animals were taken.

 

The Ventura County Sheriff’s Office launched an investigation and BERRY was identified as the suspect connected to the crimes. BERRY was arrested on September 28, 2022, on four felony violations including two separate second-degree burglaries, grand theft, and animal cruelty.

 

Two days after his arrest, BERRY appeared for arraignment in the Ventura County Superior Court.

 

On November 9, 2023, BERRY pled guilty to felony commercial burglary over $950 and felony cruelty to an animal. “He also admitted to the special allegation that the crime involved great violence”, stated a release by the Ventura County District Attorney’s Office.

 

On December 13, 2023, BERRY, of Newbury Park, was sentenced to only “180 days in Ventura County Jail and 24 months of formal probation”, announced the Ventura County District Attorney Office. As part of his probation terms, BERRY “is prohibited from owning any animals.”

BERRY will begin serving his jail sentence on December 28, 2023.

 

A restitution hearing is also scheduled for January 16, 2024, at 9:00 a.m. at Ventura County Superior Court.

 

Deputy District Attorney Nadia Aboujawdah, who prosecuted the case said: “The tragic loss of Pretty Girl has left a hole in the hearts of many at Paw Works and within the surrounding community. I am pleased to see the defendant is being held accountable for his actions, and hopeful that this conviction brings some peace and closure to those who loved and cared so deeply for Pretty Girl. We will strive to continue protecting our local businesses, while sending the message that the mistreatment of innocent animals in this community will not be tolerated.”

 

It did NOT bring me any peace or closure!

Paw Works was supposed to be Pretty Girl’s second chance in life and BERRY took it upon himself to take that opportunity away from her! This FILTH will only spend 180 days in jail, and as an additional compassionate gesture toward him he will not be spending Christmas behind bars because he is allowed to start his sentence on December 28!
