Following an investigation into animal abuse and neglect, on the morning of Tuesday, January 31, 2023, deputies with the Animal Services Unit of the Buncombe County Sheriff’s Office served a search warrant at a property on 138 Tall Tree Lane in Leicester and arrested 39-years-old LINDSEY TREVOR RUE (pictured).


The animals found at the home were suffering from neglect and were removed with the assistance of the ASPCA (American Society for the Prevention of Cruelty to Animals).


The ASPCA said they rescued more than forty (40) neglected dogs, primarily Poodle mixes. In a press release, the agency also said: “The dogs, including nine newborn puppies, along with a tortoise, a rabbit, a fish, and several birds, were found living in neglectful conditions in an overcrowded mobile home in Leicester. “

Sadly, one horse was found dead from starvation.


KAKE.com reports that Major John Ledford with the Buncombe Sheriff’s Office said investigators have been working the case since November 2022, when the agency began receiving reports about potential animal neglect on RUE’s property.


As indicated in the press release by the ASPCA, the organization is assisting the sheriff’s office “with operational planning and animal removal, evidence collection and crime scene processing, investigative and legal assistance, veterinary and behavioral forensics exams, daily care, and providing the dogs with medical and behavioral support.”


Ms. Alyssa Fleck, a spokeswoman for the ASPCA, said: “Since we don’t have ownership of the dogs, it’s too early for us to begin exploring placement options.”


RUE is charged with felony kill animal by starvation, felony animal cruelty, child neglect, and resist, delay or obstruct. She appeared in court on Wednesday, February 1, 2023, and court records show that she is due back on February 22, 2023.

The sheriff’s office said additional charges may be forthcoming as this investigation continues.

Between January 18, 2023, and January 20, 2023, Burke County Animal Services/Animal Enforcement seized a total of eighty-eight (88) animals from two properties in Morganton owned by 54-years-old JULIE ANN SHERRILL (pictured), of 1945 Eastbrook Circle, Morganton.


On Wednesday, January 18, 2023, SHERRILL was served a search warrant and the agency seized thirty-nine (39) chickens and thirty-two (32) miniature horses. Officers also discovered additional properties with horses whose guardian was learnt to be SHERRILL, and after additional search warrants were issued on Thursday and Friday, seventeen (17) more miniature horses were removed by Burke County Animal Enforcement, bringing the total to forty-nine (49) horses.


Eight of the latest seventeen horses had cockleburs, six others had a body condition score of three or less, one other horse had a body score condition of four and another horse had a body score condition of five.

Nine horses housed in a different location, were well-cared for by a good Samaritan who hadn’t heard from SHERRILL since November. “The horses were taken to prevent owner reclamation and possible abuse/neglect,” reports WBTV.


While serving the search warrants at the two locations, officials found dead animals and the skeletal remains of other animals. Investigators said some miniature horses were found to be staying alive by eating mud/dirt and sawdust-like material.


As for the chickens, officials said that they are generally healthy but were found with lice and some will need medical attention.


The search warrant follows a necropsy report on a miniature horse, found on one of the properties, which revealed that the poor animal died of starvation.


SHERRILL was arrested on Monday, January 23, 2023, and court records show she was charged with twenty-three misdemeanor cruelty to animals. Additional charges are pending. SHERRILL was released after she posted a $2,500 bond. According to court records, SHERRILL is due in court on the morning of Friday, February 17, 2023.

A reward is being offered in exchange for information leading to the arrest of 50-years-old RICHARD (RICHIE) C. RUSSELL (pictured) for murdering three innocent dogs on the morning of Thursday, January 5, 2023, in Burt, a hamlet in the Town of Newfane.


The Niagara SPCA said in a Facebook post that RUSSELL, previously of Niagara Falls, faces three animal cruelty charges after he shot and killed two Beagle mixes named Lucy Lou and Moo, and a Pitbull-type dog named Princess.


According to the Niagara SPCA, RUSSELL and his wife were evicted from an apartment on Whitney Avenue in Niagara Falls on the night of Wednesday, January 4, 2023, and while they took the three dogs with them, they left behind a cat, two fish, and two turtles. The animals who were abandoned, have since been removed by SPCA agents and are receiving medical care.


As stated by the Niagara SPCA, SPCA Investigators recovered the lifeless bodies of Lucy Lou, Moo, and Princess, on the morning of January 6, 2023, in the backyard of a home in Burt. The Niagara County Sheriff Crime Scene Unit was onsite to assist.


Examinations and x-rays of the remains of the three dogs confirmed that all three were shot at close range with a .22 caliber rifle. Fragments of bullets were removed from one of the dog's jaws during examination,” said the Niagara SPCA.


Reportedly, RUSSELL and his Russell and his wife were later dropped off at a bus station in Buffalo and the nonprofit was told that the couple were heading to the Burlington, North Carolina area to stay with relatives.
