KYLE WARREN NESBITT arrested for beating up an eight-pound Chihuahua for peeing on his bed

“Hello everyone, I’m Sheriff Wayne Ivey and today I’m gonna be walking a real tough guy into our jail. I mean, he’s so tough, he beat up a Chihuahua. That’s right, you heard me”.
That’s how Brevard County Sheriff Wayne Ivey started his Facebook reel announcing the arrest of 41-year-old KYLE WARREN NESBITT (pictured).
The affidavit obtained by Voice For Us accused NESBITT of injuring an eight-pound
Chihuahua named Bear for urinating and defecating on his bed.
The incident happened back in January of this year.
According to the affidavit, on January 30, 2026, Bear’s guardian, whom I will refer to as Ms. M., called the sheriff's office and stated that she believed her ex-boyfriend, NESBITT, “abused her canine”.
Animal Enforcement Officer Holder met with Ms. M., and she said that on the night of January 28, 2026, she stayed at NESBITT’s residence on Mobiland Drive, Melbourne. The following day she left for work leaving Bear “in the care and custody” of NESBITT.
During the day, NESBITT texted Ms. M. to tell her that Bear had peed on his bed, so he dropped Bear off at Ms. M.’s residence in Palm Bay and dumped him on the back porch.
When Ms. M. returned to her residence, she found Bear with “multiple injuries, to include puking, missing a tooth, and bleeding”, stated the affidavit.
Ms. M. blocked NESBITT and he called her mother saying that he did not hurt Bear. He claimed that he tripped and fell on Bear as he was holding him.
Ms. M. showed AEO Holder that Bear struggled to open his right eye, was wheezing, struggled to walk, would not eat or drink, was lethargic, and did not seem alert, or aware of his surroundings.
AEO Holder issued Ms. M. a twenty-four-hour notice to seek veterinary care.
Ms. M. took Bear to Animal Specialty & Emergency Center of Brevard on 2281 W. Eau Gallie Boulevard, Melbourne where Dr. Matthew Hammett examined Bear.
Medical reports revealed that Bear “suffered from a suspected traumatic brain injury, as well as pulmonary contusions”.
On January 31, 2026, Ms. M. texted AEO Holder to advise him that she had taken Bear to the vet and sent him pictures and medical reports.
On February 20, 2026, AEO Holder went to Animal Specialty & Emergency Center of Brevard and spoke with Dr. Hammett. AEO Holder asked him whether Bear's injuries were consistent with someone tripping and falling onto him. To that, Dr. Hammett responded: “I would say it would be very low likelihood that the injuries that were presented were from like an accidental fall”.
Dr. Hammett provided additional details to support his statement. He explained that Bear presented with signs of head trauma and added that a fall does not cause the level of injuries Bear had on his body. Furthermore, Bear had three different points of swelling, one being on his head, one being on his neck, and one on his chest, which is inconsistent with a fall. Bear also had pulmonary contusions caused by “blunt force to the chest area”. Dr. Hammett went on to stress that Bear’s injuries were consistent with physical abuse, or being hit by a vehicle.
When NESBITT met with AEO Holder on March 2, 2026, he called the incident a “huge misunderstanding”.
As part of AEO Holder’s extensive investigation, video from a security camera belonging to NESBITT’s neighbor was reviewed.
AEO Holder developed probable cause to arrest NESBITT on one count of aggravated felony animal cruelty.
NESBITT was taken into custody on April 10, 2026, and booked into the Brevard County Jail.
Bond was set at $15,000.
Records show NESBITT was released the same day of his arrest.
