KIMBERLY AMERICA FRESCAS arrested after the rescue of her “severely underweight” dog whom she wished would “just pass away already”

The El Paso County Sheriff’s Office announced the arrest of 26-year-old KIMBERLY AMERICA FRESCAS (pictured).
El Paso County Animal Welfare received a report from PAWsitive Rescue regarding a dog in poor condition at a property in the 1000 block of NW 2nd Street in Fabens. On June 17, 2026, officers responded to the given address to investigate and found a dog who was “severely underweight.”
The sheriff’s office spokesperson Priscilla Contreras identified the furvictim as a 6-year-old Pug named Toby.
Investigators identified FRESCAS as Toby’s guardian. According to investigators, FRESCAS told them that “Toby had been sick for more than two weeks and admitted she had not sought proper veterinary care.” FRESCAS went on to say that Toby had eaten pizza and became sick right after. FRESCAS claimed that Toby vomited and refused to eat or drink.
Investigators also said that FRESCAS stated she wished Toby would “just pass away already.”
Animal Welfare removed Toby from the property the same day and took him for medical treatment. Veterinary reports showed Toby weighed only half the average weight of an adult male Pug. Moreover, the vet who handled Toby’s care told investigators that Toby ate “ravenously” the food he was given at the clinic, proving that FRESCAS lied about Toby refusing to eat.
Five days after Toby’s rescue, on June 22, 2026, detectives obtained a warrant for FRESCAS’ arrest. She was taken into custody and charged with cruelty to non-livestock animals. She was booked into the El Paso County Detention Facility and her bond was set at $4,000. Jail records show she was released on June 24, 2026.
